1. Acceptance of Terms

By accessing or using the Gorgen EV Charging Installations website at gorgenevcharging.com (the "Site"), submitting a contact or quote request form, or communicating with us regarding our services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, please do not use this Site or submit any requests for services. These Terms apply to all visitors, users, and others who access the Site or request services from Gorgen EV Charging Installations.

We reserve the right to update these Terms at any time. Changes take effect when posted to this page. The "Last updated" date at the top of this page reflects the date of the most recent revision. Continued use of the Site following posted changes constitutes acceptance of the revised Terms.

2. Permitted and Prohibited Use

You may use this Site for lawful purposes related to evaluating, requesting, or obtaining commercial EV charging installation services for commercial or multifamily properties located within our service area.

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local laws or regulations
  • Submit false, misleading, or fraudulent information through any form or communication
  • Attempt to gain unauthorized access to any portion of the Site or its underlying infrastructure
  • Use automated tools (bots, scrapers, crawlers) to extract content or data from the Site without our prior written consent
  • Reproduce, copy, distribute, or commercially exploit any content from the Site without permission
  • Transmit any unsolicited commercial communications ("spam") through the Site's contact forms
  • Interfere with or disrupt the integrity or performance of the Site

This Site is intended for commercial and business use. We do not serve residential homeowners and our Site is not intended for residential use.

3. Quote Requests and Site Assessments Are Non-Binding

Submitting a contact form, requesting a site assessment, or receiving a verbal or written project estimate from Gorgen EV Charging Installations does not constitute a binding contract, commitment, or agreement to purchase services.

Any cost ranges, project estimates, or budget figures communicated during a discovery call, site visit, or preliminary consultation are non-binding estimates based on information available at that time. Final project pricing is established only through a formal written proposal or executed contract signed by an authorized representative of Gorgen EV Charging Installations.

Actual project costs may vary from estimates due to changes in site conditions, scope of work, material costs, permit requirements, utility interconnection conditions, or other factors identified during detailed design or construction. No legal obligation to perform work or honor an estimate arises until both parties have signed a written contract.

4. Disclaimer Regarding Incentive Programs and Tax Credits

This Site and our representatives may reference incentive programs including, but not limited to, the SCE Charge Ready program, the California Electric Vehicle Infrastructure Project (CALeVIP), the federal Section 30C Alternative Fuel Vehicle Refueling Property Tax Credit, and NEVI formula program funding. Any reference to these programs is provided for general informational purposes only.

Incentive amounts, eligibility requirements, program funding availability, and application deadlines change frequently and without notice. Gorgen EV Charging Installations makes no warranty or representation that any specific incentive amount will be available, that your property will qualify for any program, or that any stated rebate or tax credit amount is current or accurate as of the date you read it.

The federal 30C tax credit involves complex eligibility requirements and phase-in provisions. The credit percentage, per-charger cap, prevailing wage requirements, and property type eligibility are subject to IRS guidance and Congressional action. Nothing in our materials constitutes tax advice. You should consult a qualified tax professional before making business decisions based on anticipated tax credit amounts.

CALeVIP program funding is appropriated and disbursed by the California Energy Commission and its program administrators. Funding is limited, first-come first-served, and subject to change. We will use commercially reasonable efforts to identify current program availability for your project, but we do not guarantee program participation or funding awards.

5. Intellectual Property

All content on this Site — including text, graphics, logos, page layouts, service descriptions, and design elements — is the property of Gorgen EV Charging Installations or its content suppliers and is protected by applicable United States and California intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site for your personal evaluation of our services. This license does not permit copying, redistribution, commercial use, modification, or derivative works without our express written permission.

Written site assessment reports, project proposals, and design documents prepared by Gorgen EV Charging Installations for your project remain our intellectual property until full payment has been received, unless otherwise specified in a written contract.

6. Disclaimer of Warranties and Limitation of Liability

This Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Gorgen EV Charging Installations does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or currency of any information on the Site, including information regarding incentive programs, project cost ranges, or regulatory requirements.

To the maximum extent permitted by applicable California law, Gorgen EV Charging Installations and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or reliance on any information contained herein — including but not limited to damages resulting from reliance on incentive program availability or estimated project costs.

Our total liability to you for any claim arising under these Terms, whether in contract, tort, or otherwise, shall not exceed the amount you have paid us for services in the twelve (12) months preceding the claim, or $100, whichever is greater.

Nothing in these Terms limits liability that cannot be excluded under California law, including liability for fraud, gross negligence, or willful misconduct.

7. Third-Party Links and Resources

This Site may contain links to third-party websites including utility program portals, government agency sites, and equipment manufacturer pages. These links are provided for convenience and informational purposes only. Gorgen EV Charging Installations does not control, endorse, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Access to third-party sites is at your own risk and subject to their terms of use.

8. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our services that cannot be resolved through good-faith negotiation shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California. You consent to personal jurisdiction in those courts and waive any objection to venue.

For active project contracts, dispute resolution provisions in the executed contract govern over these general Terms.
